2014 Fox C-6 School Board Candidates Voter's Guide in the Arnold-Imperial Leader

I didn't find any information on Vernon Sullivan's education in his information. It's very evident that Vern Sullivan is a very busy person. I would be concerned that he wouldn't be able to dedicate any time towards being a Fox C-6 school board member with all of his other commitments.

It also appears that Vern Sullivan is the only Fox C-6 school board candidate that has someone working for the school district. It's reported that Vern Sullivan has two sons working for the district with one of them being in a supervisory position. Based on what's happened over the past 9 years with Superintendent Dianne Brown-Critchlow and school board members with spouses or children on the school board, I believe that having Mr. Sullivan on the school board would NOT be good for the community.

In 2008, Superintendent Brown had Vern Sullivan call my father into Dianne Brown's (now Critchlow) office and tell my father to tell me to stop pursuing our complaints with the federal agencies that the Missouri DESE compliance officer told me to file with the U.S. Department of Education's Office for Civil Rights (ED OCR) and the USDA's Office for Civil Rights. I didn't know that you could file complaints with the ED OCR until I spoke with the Missouri DESE compliance officer. He even walked me through the process while I was on the phone with him. He told me that we should file a complaint because what Fox was doing was wrong. To me, what Vern Sullivan and Superintendent Brown did to my father was a bullying tactic which runs contrary to Mr. Sullivan's campaigning for abolishing bullying. Perhaps Mr. Sullivan is only referring to student bullying.

In 2009, Fox C-6 signed a Resolution Agreement with ED OCR to make corrections to it's school board policies and other corrections. After 4+ years, Fox still hadn't fulfilled the Resolution Agreement. USDA OCR found the district Non-Compliant with Federal Laws in 2011 and was told to make immediate corrections. The district spent hundreds of thousands of dollars fighting ED OCR and USDA OCR over the past 5+ years. Superintendent Critchlow has brushed off the Resolution Agreement and the USDA Ruling as litigation even though there were NO lawsuits filed. The Federal agencies simply investigated and found problems in the district and with the law firm's interpretation of the law. By referring to them as litigation, Superintendent Critchlow has been able to hide the information from the public. Our school board has been willfully blind to these problems. You can easily obtain the information regarding these issues by filing a Freedom Of Information Act request with ED OCR and USDA OCR.

I didn't see any mention of transparency by Vern Sullivan in his campaign information as well. That is still a huge problem in the Fox C-6 School District. It appears that Superintendent Critchlow wants to keep as much information as possible away from the public. She obviously doesn't want school board meetings recorded because I've asked the board to record school board meetings many times over the past 3+ years and have never been given a response. It could be that she doesn't want to record them because another district attorney told a parent advocate that, "Tape recordings are notoriously unreliable." Fox used to record school board meetings in the past. So why did they stop?

I believe that Superintendent Critchlow doesn't want board meetings, IEP meetings or Section 504 meetings recorded because she can't refute what's been recorded. She's been caught having to change her story many times because of my audio recordings of Fox C-6 school board board meetings. If there's no audio recording, Superintendent Critchlow can document board meeting minutes with minimal information and the public will never know what the school board was asked during Public Comments.

It's very important for our community that you elect school board members that are honest and are willing to stand up for the community. Your school board members represent the community and are responsible for ensuring that your tax dollars are spent wisely. Please take the time to read about your school board candidates and ask them questions while they are still allowed to speak with you.

Fox C-6 March 19, 2013 Board Meeting Report

More Realistic Than Last Month
The March 19, 2013 Fox C-6 Board of Education meeting was a nice change of pace from last month's meeting. This month's meeting brought some genuine highlights of students and teachers that are making a difference in the district. A student from Fox Elementary was highlighted for her heroic action of using the Heimlich maneuver to save a fellow classmate from choking on a piece of popcorn chicken. The American Heart Association honored Rockport Elementary for its fund raising efforts this year by raising over $33,000 for the American Heart Association. It was the top fund raising school in the state of Missouri for the American Heart Association's Jump Rope for Heart. Rockport has been raising funds for more than 20 years for the American Heart Association. Mr. Steis the assistant principal at Antonia and Ridgewood middle schools highlighted some of his students that are tutoring special needs students. These were truly meaningful stories by students and teachers in our district. It was a far cry from what went on at last month's meeting during Public Comment. Last month a new school record was set for the most number of Public Comments made at a board meeting since 2001.

In contrast, the February 2013 BOE meeting couldn't have been better scripted by our superintendent in her efforts to combat the bad press that she and the district have been receiving lately. It was as if she had handed out writing assignments to 5 individuals (some being teachers) from our school district to come up with something great to say about the district. It was very amusing listening to the over the top Public Comments last month. It was even more interesting to see how they were documented in the board meeting minutes in contrast to how my comments were documented. It speaks volumes as to how our district filters the information to keep the public from getting an honest summary of board meetings and the public's concerns. At least the minutes stated more than "Concerns within the district" which is how my Public Comments were documented in the December 2010 BOE meeting minutes. I emailed the board regarding my comments being documented as "Concerns within the district.". I received quite an unprofessional response from our superintendent informing me that our school board secretary had contacted the Missouri School Board Associations's legal counsel and that the board meeting minutes fully complied with the law. I wonder if anyone remembers what my "Concerns" were back then?

Last month our superintendent wanted to make sure that the community knows how great a job our school board is doing right before the election. She has been doing this for years in the local papers. She needs to keep the incumbents in place. I am sure that everyone in the community has already forgotten about the recent decision by our school board to hire the daughter in law of our school board president as the district's new Director of Food Nutrition Services for $65,000 a year. Linda Nash's daughter in law has a high school diploma and had worked at McDonald's for 17 years.

This month I felt that I needed to address my concerns regarding the Cease and Desist letters that the district has been spending taxpayer dollars to send out to citizens in our community for voicing their concerns and opinions and for asking the school district to be accountable and transparent. These letters were sent to try and silence those being critical of our district.

Public Comments
There is not a whole lot you can say in 3 minutes to get your point across to the school board and administration and inform the Public. It slows the progress of change by restricting what can be conveyed to the board and the public. That's also why there are blogs like this so more information can be conveyed to the public; and, so they can become more educated on the process and what is really happening within our school district.

Since this was the last board meeting prior to the election, I felt that it was really important to point out a systemic problem that has been occurring for more than 2 years. It is a fact that there have been individuals posting in an online forum known as Topix. I happened upon this website in October 2010 while researching information about the district to send to the U.S. Department of Education's Office of Civil Rights (ED OCR)It is like the gossip channel for communities across the nation. Comments can be posted anonymously. This allows anyone to say anything about anyone without fear of reprisal to the real poster of the comment. In fact, I have been the subject as well as my parents of many false, defamatory and slanderous comments over the past couple of years because of my efforts to educate our school board and inform the public. 

What was my major point in telling the board about this? Despite the false accusations and claims posted on TOPIX that I was the person making posts in this online forum, I have not posted on Topix in over 2 years.

So, while some Fox C-6 administrators may be mad that people were speaking about them over the last couple of years on TOPIX, I have not been the one posting those comments. Nor did I ask anyone to post comments on that site for me.

The first slanderous comment directed at my parents and I was posted only a week after I spoke at the December 2010 school board meeting and 2 days before an article was published in the Leader newspaper about the newly appointed head football coach at Seckman High School. What a coincidence! Especially given the fact that there were only 7 people in attendance at the December 2010 board meeting besides the board members and administrators. Those in attendance included myself, a reporter from the Leader and a few students and a couple of accountants. The board meeting minutes didn't get posted for over a month and then there weren't any details of my public comments in those board minutes.

Recently, the personal attacks made against me have really picked up after I spoke at the December 2012, January 2013 and February 2013 board meetings. Those personal attacks have also been directed at others who have voiced their concerns about our school district, superintendent and school board. I believe as well as many others in our community that there are only a few people that would be so upset over critical comments made of our superintendent and school board. The language in the posts and the people that have been attacked speaks even louder as to who might be posting these defamatory and slanderous comments. Even more telling is the fact that some of the information posted would have only been known to school administrators. As I stated in my public comment at the March 2013 board meeting, remarks such as those that have been posted online, would lead to the dismissal of any educator who would make such comments. Rather than calling people names and making false accusations, they should be addressing the problems and criticisms rather than risking their careers.

I would like to report that I have been getting a lot of positive feedback from the community and from teachers and staff and even retirees for my efforts in helping to bring accountability to our school district. It is good to see that the public is becoming more aware of how our school district leadership and school board has been conducting business compared to other school districts under our current administration. I think it is very important for the community to know that using taxpayer dollars to send out cease and desist letters to individuals in the community who voice their concerns at board meetings and in the community is unacceptable. It is also very unacceptable for individuals who are very well in the know of actions being taken by our administration prior to them even being public to be making slanderous comments about individuals in online forums anonymously. Well, actually they use a variety of different names all within minutes of each other but spreading the same message. This type of conduct will eventually lead to the dismissal of educators within our district if proven to be who everyone now believes to be the person or persons posting these messages.
I would like the school board to know that I have never made ANY defamatory or derogatory comments at school board meetings or to school board members as was misrepresented in the cease and desist letter sent to me by our school district last fall. I would also ask that our school board read up on Missouri’s Anti-SLAPP law regarding this topic. Our school board and administrators should also know that I have not posted anything on the TOPIX online forum for more than 2 years. I made a total of 18 posts between October 2010 and January 11, 2011 providing statistical data and information from Missouri DESE and school board meeting minutes and information regarding a District Wide Compliance Reviews that was being conducted by the Office of Civil Rights of our school district. That Compliance Review has been ongoing since March of 2010. I certainly have not deserved the crude and slanderous remarks that have been made against me and my parents for my advocacy efforts and efforts to hold our school district accountable. You have some very serious issues to deal with and I am glad that the community is beginning to realize that things aren’t as glowing and as positive as you would like everyone to believe.
So, in closing would like to say that I certainly hope that the upcoming election will bring a new set of faces to our school board and that our district begins to head in a new direction. It will take a concerted effort by our community to encourage a change in leadership. It will also require that our school board and school administrators conduct themselves with the Character traits of Honesty and Integrity that they so often tout.

I have been asked by quite a few people including my parents as to who I support for the upcoming Fox C-6 School Board election. I am putting my support behind Mark Jones and Steve Holloway. Mark Jones is a 1985 graduate of Fox High School and Steve Holloway is a 1990 graduate of Fox High School.

My father told me just the other day that he thought Mark Jones had a good chance at getting on the school board. He said that having 6 people running for 2 positions makes it more difficult but he still liked his chances. I was really glad to hear that from my father. My father knows a lot of people in our school district and in the community.  He and my mother are very well respected and his remarks should say a lot to the community. I hope Mark Jones and Steve Holloway gets elected to the school board. Both Mark and Steve have a background in computer science and work in the technology field. Their skills could benefit our school board and community greatly.

Fox C-6 Board Member Touts Bringing School District to National Recognition

Cheryl Hermann is running for Jefferson County Council – District 2 in the November 6, 2012 election.  Ms. Hermann recently stated in the October 25, 2012 edition of The Leader newspaper that people should vote for her because, “My experience working collaboratively as a school board member, helping to bring Fox board from ineffectiveness, controversy and lawsuits in 2000 to a nationally recognized school district in 2012.”  Ms. Hermann did not say what kind of national recognition that the school district received.  But, a Google search for “Fox C-6 504 Compliance Reviews” will find presentations from across the country where Fox C-6 has been recognized nationally as being chosen as one of two school districts out of the entire nation that are undergoing a Discrimination Review being conducted by the U.S. Department of Education’s Office for Civil Rights for ensuring access to appropriate services for students with medical and health conditions and impairments such as food allergies and diabetes.  This is definitely an honor to have been chosen as not too many school districts undergo District Wide Compliance Reviews nationally.  To save a little time, I have included one of the top results from a Google search from the Nashville Public Schools website: (www.mnps.org/AssetFactory.aspx?did=60645).

This was a presentation given by a law firm at the Spring Forum 2011.  You will be able to find Fox C-6 on slide #30 titled Current OCR Disability Discrimination Reviews.

Fox C-6 was informed of their impending District Wide Compliance Review in March 2010 by Russlyn Ali, the Assistant Secretary for Civil Rights of the U.S. Department of Education.  The District Wide Compliance Review is still ongoing as the district attorneys have notified me in the past when I made inquiries to the school board regarding this issue.  I also made Freedom of Information Act (FOIA) requests for information pertaining to the results of the Compliance Review.  At this time since the Discrimination Review is still ongoing and there is nothing to report according to the FOIA request response.

How long does it take to do a Compliance Review?

I would like to note that it is a fact that the Compliance Review is being conducted even if the district has not publicly acknowledged this information.

Another interesting Google search is for “Fox C-6 504 Resolution Agreement” which will also find presentations from across the country which documents a Resolution Agreement signed by the school district on May 1, 2009 which has an LRP publication number of (109 LRP 54751 (OCR 2009)).  Here is a direct link to one of the presentations discussing the Resolution Agreement at a national level and can be found on the Utah State Office of Education website: (www.schools.utah.gov/sars/DOCS/disability/emer504.aspx).

In the Resolution Agreement the district agreed to update its 504 Manual, policies and procedures to remove references to mitigating measures and to incorporate a definition of a person with a disability that is consistent with the ADAAA.  Revisions will include but not be limited to, defining 'major life activities' as they are defined in the ADAAA and removing references to any court decisions that were specifically rejected by the ADAAA.  Additionally, it was identified by ED OCR that district policies and student handbooks identified at least 7 different contacts as the Section 504 coordinator for the district.  One of which has been retired since 2008.

You may ask how long does it take for the district to update its documentation as requested?  School board members Cheryl Hermann and Dan Smith should be asking questions as to why it is taking the district so long to produce these documents?  Does it truly take more than 3 years to update documents in our school district?  This responsibility should also fall on the shoulders of the superintendent.  Does this demonstrate effective leadership or management skills?  It has already been more than 6 months since the 'completely overhauled' school board policies, regulations and forms were released for review.  The district informed ED OCR that they would be providing updated policies to ED OCR by August 28, 2012 as part of the Resolution Agreement after failing to meet previously set deadlines informing ED OCR that the update policies had to first be approved by the school board.  The school failed to meet that deadline and ED OCR extended the district deadline another 2 months.  Perhaps Cheryl Hermann and Dan Smith can explain why these deadlines are consistently not being met?

So, it seems that national recognition can have different meanings for different people.  And certainly the amount of legal fees spent in making corrective actions and challenging the U.S. Department of Education and USDA Final Agency Decision should be recognized as part of Ms. Hermann’s, “experience and proven actions as an elected official on the Fox school board.”  Those legal expenses can be found in the school board packets which contain the Check Register listings for payments made to vendors that are approved each month by the school board.  You simply need to know the name of the law firm or other law firms that have been involved in order to total up the cost to the taxpaying public.  Legal expenses have now exceed well over $200,000!

Ms. Hermann is running on the idea that she is “A Voice Of Reason and Common Sense!”  Is it Common Sense to fight the U.S. government with local taxpayer dollars?  Wouldn’t it have been much cheaper and easier for the school district to simply comply with Federal Laws rather than continue spending taxpayer dollars on legal fees?

I recently learned that a different attorney from the school district law firm has to get up to speed on these matters as the current one is retiring.  At least that was the reason given this time by Karl Menninger from the Kansas City U.S. Department of Education Office for Civil Rights (ED OCR) office monitoring the Resolution Agreement in a recent email.  However, this was the same reason given to Senator Roy Blunt’s office by the KC OCR office in May 2012.  It begs the question as to how long does it take to get up to speed?  Attorneys are needed to help review and help produce documentation that ED OCR has been requesting from the district since May 2009?  Luckily for the school district, ED OCR graciously continues to provide the district with new deadlines each time it doesn't meet them rather than take enforcement actions or reopen the investigation like their regulations allow them to do.  Per an email from Rosanne Shepherd of Kansas City ED OCR, “OCR is continuing our efforts to allow the District to comply with the voluntary agreement.  The District has not indicated they refuse to comply with the agreement, therefore, at this time OCR has not decided if it will reopen the investigation or to move to enforcement.  OCR will continue to monitor the District’s compliance with the agreement and will keep you informed of monitoring activities.”

Mr. Dan Smith another Fox C-6 school board member should also take credit for helping bring this type of national recognition to the Fox C-6 school district since he has been a school board director since April 2008 before all of this occurred.  By the way, Dan Smith is running for Missouri State House of Representative in District 113.

Fox C-6 Board Member Dan Smith Wants To Make Government “As Transparent and Easy To Understand As Possible”!

Dan Smith is running for the Missouri State House of Representatives in District 113 and wants to go to Jefferson City.  He stated in an Arnold Patch article on March 1, 2012 that “We need to give government back to the people and make it as transparent and easy to understand as possible.”  If that is the case, perhaps Mr. Smith can explain why the Fox C-6 School Board and School District have refused to publish the school board packets on the district website as I have been requesting for quite some time.  That would show that he truly believes in transparency and it’s not just political talk!  I have made Sunshine Law requests personally to obtain copies of the board packets which are sent out every month to the board members.  However, I have only been provided the board packets AFTER the board meetings have occurred and not before even though I have requested otherwise.  Additionally, the patrons of the district have not been informed of decisions made by the school board until more than a month after a school board meeting.  The board minutes are not published onto the district website until after they have been approved at the next school board meeting.  I have asked for Draft Copies which should be available within 3 days of a school board meeting per Sunshine Law and have been able to obtain some draft copies using that method.  But, why can’t those draft board meeting minutes be published on the district website like other school districts?  That would give the appearance that our school district is attempting to be transparent rather than giving the appearance of trying to hide information.

Board packets are provided to the board members ahead of board meetings so they can review the information prior to the meeting and hopefully make informed decisions for the patrons of our school district.  However, the patrons of the school district have not been afforded the same transparency that Dan Smith is touting as part of his campaign.  If so, the district would graciously publish the board meeting packets on the district website for the patrons to review prior to the upcoming school board meeting allowing patrons to ask their board members who represent them questions concerning those issues prior to the board members voting on them.

Doesn’t that seem like a reasonable request?

You should contact your two school board members Mr. Dan Smith and Mrs. Cheryl Hermann who are both running for other public offices while still serving as school board members, why the patrons of our school district are not provided the same information as the school board members prior to school board meetings?  MANY other school districts publish their board packet information on their district websites prior to school board meetings.  Wentzville is a great example of transparency in action.  I gave Wentzville as an example at the August 2011 board meeting and brought it to our school board’s attention.  However, I was told by Mrs. Dianne Brown, our superintendent, that our school district does not have a dedicated person maintaining the district website in order to do that and instead chooses to put its money into the classroom.  Really?

That was a very interesting statement that our superintendent made considering the fact that after receiving copies of the board packets through Sunshine Law requests which included the salary schedules for district employees, I found that the district does indeed have a full time person employed as a Web Designer.  That person makes over $40,000 per year and has been with the school district for more than 7 years.  So, her explanation as to why the documents can’t be posted on the website doesn’t seem very credible now does it?

So, what is so difficult for that person to publish our school board packets onto the district website?  It is a simple drag and drop of a file onto a district web server file folder and then creating a hyperlink on a web page.  Maybe it is due to the fact that salary schedules and check register listings are contained in the district board packets?  School employee salaries are Public Information and the taxpayers/patrons of our school district do have the right to know how our taxpayer dollars are being spent.  The check registers include payments to all vendors paid each month and those payments are presumably reviewed by our board members and then approved each month since there is a motion each month documenting the approval of those payments.

So, Mr. Dan Smith, since you refuse to respond to my emails, maybe you can explain to other constituents why our school district does not publish school board packets on the district website or for that matter why our district website is in such a mess compared to other districts that our superintendent likes to compare us to.  I challenge our school district patrons to find an email address for Mr. Smith or Mrs. Hermann on our district website to contact them directly.  You will not find one.  What you will find is an email address which states that it goes to the school board which is schoolboard@fox.k12.mo.us.  However, in reality it goes directly to the school board secretary who forwards it to the appropriate person and not directly to the school board as you are lead to believe.  You also won’t find any other contact information for our school board members such as an address or phone number like there are on many other school district websites in the area.  Why is that?

Mr. Smith also stated in his March 2012 Arnold Patch article from his press release when he announced his run for State Representative, “People in the community need someone who is approachable.“  So, how approachable is Mr. Smith if he has NO contact information as a school board member on the school district website?  I have asked the school board several times to publish email addresses, phone numbers and addresses for our school board members and have been told that they are not on the website.

It does not appear that our school board members really want to listen to or represent the will of our community if you cannot contact them does it?

Will things change if they hold a different office or should you rely more so on the examples they have shown to our community while they have been school board members?

You will have your chance to decide on November 6, 2012 as to whether or not you believe Mr. Smith will do what he says he will.  I personally believe that Past Actions Speak MUCH LOUDER than Words!  Don’t you?
